The International Labour organization (ILO) sets global standards for ethical recruitment and calls on member countries to promote fair and transparent recruitment practices. In particular, the ILO emphasizes the protection of workers' rights and the prevention of forced labor and exploitation.

Legal Regulations in Germany

In Germany, there are clear legal provisions for the recruitment of workers, particularly from third countries such as Kenya. A distinction is made between recruitment fees for workers and recruitment fees for employers:

No recruitment fees for workers: It is illegal to charge recruitment fees to workers. This applies to both domestic and international recruitment. Employment agencies are not allowed to charge workers any fees for recruitment or the organization of visas and work permits.


Recruitment fees for employers: Employers, however, may pay recruitment fees to private employment agencies for the recruitment of workers. These fees are common practice when companies commission an agency to recruit qualified workers. However, these fees cannot be passed on to the workers.


Ban on exploitation and coercion: Legal regulations are designed to protect workers from forced labor and exploitation, ensuring that the recruitment process is fair and transparent.

 

These provisions ensure that the recruitment of workers from Kenya and other third countries takes place in an ethical manner, without imposing unlawful fees on workers.
